Introduction
Not Yet Applied has a simple license system that distinguish between commercial and non-commercial contexts. Our objective is to encourage the use of Not Yet Applied fonts in a wide range of settings. To do this, full character set versions of our font catalogue can be accessed through Test Fonts. However, any Commercial Application will require proof of license purchase. This also applies should non-commercial usage cases later become Commercial Applications.
What is the License Agreement?
This is an agreement for usage between your Entity, the Licensee, and Not Yet Applied. By purchasing and installing or handling the digital typeface software, herein referred to as 'Font(s)', you accept the terms of this agreement. If you do not accept the terms, you may not download or request or use any Not Yet Applied fonts.
A commercial company, organisation, individual or any other kind of Entity for which the Fonts are being used is considered a Licensee and needs to hold a License reflecting the Size of Entity in question for the Commercial Application of the Fonts.
You are not receiving the ownership of the copyright to the design or any other part of the Fonts, but the rights to use the Fonts as specified in this agreement. Your purchase is for the permission to use the font software in the context of the needs of your Entity.
You are granted a perpetual license to use the Fonts worldwide in all media as part of any design, texts and marketing activity (including but not limited to, printed materials, logos, websites, marketing material, TV broadcast, events etc.). You may not distribute, lend, rent, sell, give away, publicly or privately share any modified or unmodified version of the Fonts.
Commercial Application Explainer
Commercial Application of Fonts covers any usage that seeks to financially gain through use of the Font image. This may include (but is not limited to) on commercial and promotional products, both physical and digital, as well as in communication and messaging that contributes to an objective of financial gain or increased brand perception of an organisation seeking financial gain.
Custom Modifications
Fonts may be outlined and modified but may not be re-exported or adapted in a font editor. Any outlined modifications used in a Commercial Application will require a License for usage. Any required extended character sets or custom modifications to Fonts should be discussed directly in the scope of a bespoke project.
Font Issues
If you experience any difficulties with our Fonts, we will try to resolve the problem but due to the broad nature of usage cases and platforms we cannot always guarantee a solution for your situation. If a solution is possible we will re-supply an updated version at the earliest available opportunity.
Any usage cases of the Fonts are on your own risk. Not Yet Applied is not responsible for any legal issues that may occur with your usage of the Fonts.
Test Fonts
A Test Font license is free and permits you to use the Fonts for preview, evaluation and proposals for commercial client projects. Test Fonts are issued with a full character and feature set in OFT formats, however they do not include any variable fonts. For variable font access please get in contact with an outline on the nature of your project and what the needs for it are. The Test Fonts must not be shared or redistributed amongst any third party organisations or project collaborators. Collaborators must register details through this site and download their versions separately.
Refunds
All sales of font software are final. There is no way for us to verify that you no longer hold copies of the font software. If the font software is defective it shall be replaced by the same software if accompanied by a purchase receipt and we are notified within 10 days of purchase.
